The Firm has successfully defended insurers, third-party administrators, and officers and directors in litigation matters arising out of employee health, welfare, and pension benefit plans. Our experience includes the defense of long term disability claims, fiduciary duty claims, anti-cutback claims, and discrimination claims. An example of the successful results we have obtained for our clients in this area can be found in the case of Bodine v. Employers Casualty Company, 352 F.3d 245 (5th Cir. 2003), wherein the dismissal of the plaintiffs' ERISA claims was affirmed at the Federal Fifth Circuit Court of Appeals.
